The International Association for the Protection of Intellectual Property (AIPPI) conducted a study titled “Copyright and Artificial Intelligence”. Participants provided responses regarding the limitations on exclusive rights in the context of AI training. Based on a comparative overview of global approaches, on 16 September 2025, AIPPI adopted the “AI & Copyright” Resolution, which sets forth a framework for balancing the interests of right holders and AI developers.
Key provisions of the Resolution:
- The use of copyright-protected works for AI training is permissible only with the consent of the right holder.
- Such consent is not required in the following cases:
* for non-commercial scientific research and educational purposes;
* where national legislation expressly permits such use.
- The Resolution defines the categories of persons liable for the use of copyrighted works in AI training.
- AI developers and “trainers” are required to provide right holders with “adequate” information about the works used in the training process.
- The Resolution proposes liability measures for infringements involving works used in AI training.
