Commentary for EG-Yurist: "Patent or Royalty-Free Non-Exclusive Licenses? How the State Proposes to Allocate Rights Between Business and Government for Subsidized IP Results"

A draft law has been published introducing a new Article 1240.2 to the Russian Civil Code, which is aimed at regulating allocation of rights to the IP results created at the expense of, or with the involvement of, budgetary funds under a subsidy agreement or a grant in the form of a subsidy.

Dmitry Grachyov (Partner at Ermolina & Partners), and Valerya Mitrofanova (Associate at Ermolina & Partners), commented on the draft law in EG-Yurist:

“The draft law provides for three categories of entities to which rights to the created IP results may vest, depending on the presence of specific statutory conditions… It also regulates the terms for granting licenses and the mechanisms for transferring exclusive rights to the created IP results.”
