EG-Yurist has compiled the key trends for 2025 from top market experts. One of the main events was the adoption of a federal law that provides for a large-scale reform of compensation for the violation of IP rights. The changes will come into force on January 4, 2026.
Dmitry Grachyov (Partner at Ermolina & Partners) and Valerya Mitrofanova (Associate at Ermolina & Partners) commented on this law in the new issue of EG-Yurist:
"The Russian Civil Code, in particular, will enshrine the concept of infringement of IP rights, clarify the methods of calculating compensation, establish new rules for calculating compensation and the limits of compensation that can be recovered, depending on the specific method of calculation. In some cases, the court will also be able to change the method of calculating compensation on its own initiative. Also, grounds for reducing compensation in cases of no-fault liability of entrepreneurs have been established.”
