FAS proposes to abolish antitrust immunities
The FAS Russia proposes for discussion a large-scale initiative aimed at abolishing antitrust immunities. The draft law (ID 159126) has been published on the portal.
What is the essence?
The FAS wants to supplement the Law on Protection of Competition with a clause: antitrust immunities will cease to apply if the right holder takes actions aimed at preventing, restricting or eliminating competition in the product market.
In particular, such clause will be added:
• to Article 10 — on the abuse of a dominant position.

• to Article 11 — on agreements restricting competition.
FAS position
The FAS Russia believes that an exclusive right today allows the right holders to:

• Gouge prices for products;

• «Abuse market power with impunity».
Nevertheless, the FAS is confident that such a measure will not slow down innovation, but will increase competition and protect end consumers.
