- AI-generated works are not protected by copyright if they lack human creative contribution;
- A prompt is recognized as a copyrightable work if it contains human creative input;
- The use of copyrighted works for AI training does not constitute fair use (or “free use”);
- The use of copyrighted works for AI training does not infringe exclusive rights unless the right holder has expressly prohibited such use;
- The right holder may set a machine-readable prohibition on the use of their work for AI-training purposes. Until such a prohibition is established, no compensation is required.
