Artificial Intelligence Law in Kazakhstan

CIS countries are actively developing AI regulation — in Kazakhstan, the Mazhilis (the lower chamber of Parliament) has adopted at second reading the Law “On Artificial Intelligence.”

Of particular interest is Article 23, which concerns copyright. The key provisions of this article are as follows:

  • AI-generated works are not protected by copyright if they lack human creative contribution;

  • A prompt is recognized as a copyrightable work if it contains human creative input;

  • The use of copyrighted works for AI training does not constitute fair use (or “free use”);

  • The use of copyrighted works for AI training does not infringe exclusive rights unless the right holder has expressly prohibited such use;

  • The right holder may set a machine-readable prohibition on the use of their work for AI-training purposes. Until such a prohibition is established, no compensation is required.
