New Rules on Appellate Review under the Russian Civil Procedure

As of 1 January 2026, amendments to the Russian Civil Procedure Code have entered into force, modifying the procedure for filing appeals and the rules governing the reinstatement of deadlines for filing the appeals.

New Rules for Filing an Appeal

  • The appellate court now considers issues relating to the acceptance of an appeal and its being left without consideration (i.e., suspension pending the correction of deficiencies). Previously, these matters were handled by the court of first instance.

  • A motion for the reinstatement of deadline for filing an appeal must now be filed directly with the appellate court. Previously, such motions were considered by the court of first instance.

  • Additional grounds for returning an appeal to the petitioner have been introduced, including:

-the appeal is filed by a person lacking the procedural right to file an appeal;

-the appeal challenges a court ruling that is not subject to appellate review under the Russian Civil Procedure Code.

New Rules on the Reinstatement of Deadlines

A motion for the reinstatement of deadline for filing the appeal is now reviewed by a judge within five (5) days from the date of receipt by the court and may be reviewed without holding a court hearing. Previously, such motions were reviewed at a court hearing with the participation of the parties.
